Accepting these terms
These terms apply to anyone who uses this website or asks Anchorstone Oakland Concrete and Masonry for an estimate or for work. By using the site or booking a job with us, you agree to them. If you don't agree, please don't use the site, and call us before booking so we can talk it through.
In these terms, "we", "us" and "our" mean Anchorstone Oakland Concrete and Masonry, and "you" means the person using the site or hiring us. If a signed written estimate or contract for your job says something different from this page, the signed document controls for that job.
What we do and what this site is for
We're a masonry contractor in Oakland, CA, and we also do concrete work. We handle brick, block, stone, chimneys, fireplaces, retaining walls, pavers and walkways for homes in Oakland and the cities around it. You can read more about our crew on the About page and see our services from the home page.
The information on this site is general. It explains how these jobs usually go, but every wall, chimney and foundation is different, so nothing here is a promise about your job. What we'll do for you, and for what price, is set out in your written estimate or contract.
Estimates and pricing
Estimates are free and come with no obligation. We look at the work at your property before we give you a written number, because the size of the job, access, the materials you choose and the condition of what's already there all change the price.
An estimate is based on what we can see before the job is open. If we find hidden damage, such as rotted framing, failed footings or loose brick behind a face that looked sound, we'll stop, show you what we found and give you the added cost in writing before we go on. We don't charge for extra work you haven't approved.
Unless your estimate gives a different period, prices hold for 30 days, because material costs change. Permit fees, if your job needs a permit, are separate from our labor and materials unless your estimate says they're included.
Scheduling and cancellation
Once you approve your estimate, we'll agree on a start date with you. Masonry and concrete depend on weather, curing time, material delivery and inspections when a permit is needed, so dates can move. If ours has to move, we'll tell you as soon as we know and set a new one with you.
If you need to cancel or reschedule, please call us at (510) 216-0213 as early as you can. If you cancel after we've ordered special materials or started work, you'll pay for the work done and for materials we can't return, as set out in your contract. California law may also give you the right to cancel certain home improvement contracts within a set period, and your contract will explain that right where it applies.
Payment
Your contract sets the payment schedule, including any deposit and when progress payments are due. Any deposit will stay within the limit California law sets for home improvement work.
The final payment is due when the work in your contract is done. If a payment is late, we may pause work until it's caught up, and you'll be responsible for reasonable collection costs where the law allows them.
Our workmanship and what we don't warrant
We stand behind our work, and if something we built isn't right, call us and we'll come back and look at it. The specific terms and length of any workmanship warranty are the ones written in your contract.
Materials such as brick, stone, pavers, sealers and mortar carry their makers' warranties, not ours, and we'll pass those along to you. Natural stone and brick vary in color and texture, and concrete can show hairline cracks as it cures, so those are normal and not defects.
We don't warrant damage caused by ground movement, earthquakes, flooding, tree roots, poor drainage we didn't install, misuse, lack of upkeep, or changes someone else made to our work. Apart from what your contract says in writing, this website and our services are provided without other warranties, to the extent California law allows.
Limits on our liability
To the extent California law allows, our total liability for any claim tied to a job is limited to the amount you paid us for that job. We aren't liable for indirect or consequential losses, such as lost use of your property or lost rental income.
We aren't liable for anything that happens because someone relied on general information from this website rather than on an estimate for their own property. Nothing in these terms limits liability that the law doesn't allow us to limit.
If we disagree
Most problems get sorted out with a phone call and a visit to the job, so please contact us first and give us a chance to make it right. If we still can't agree, we'll both try in good faith to settle it through mediation before either of us goes to court, unless your contract says otherwise.
Any case that does go to court will be heard in the state or federal courts serving Alameda County, California, unless the law requires a different place.
Governing law
These terms, and any job we do, are governed by the laws of the State of California, without regard to its conflict of laws rules.
Changes to these terms
We may update these terms from time to time, and the version on this page is the one in force. A change won't alter the terms of a contract you've already signed with us.
Questions about these terms
If anything here isn't clear, call us at (510) 216-0213 or send a note through our Contact page, and we'll explain it before you book.
